Terms of Service

1. Service provider and agreement

These Terms of Service form an agreement between you and Nomad Node Limited, a Hong Kong company located at Room 05, 12/F, The Cloud, 111 Tung Chau Street, Tai Kok Tsui, Hong Kong. They apply to our website and the Nomad Node Studio web application, including its AI-powered image and video workflows (collectively, the “Services”). By creating an account, purchasing access or using a Service, you agree to these terms and any product-specific terms shown before purchase.

2. Eligibility and accounts

You must be legally capable of entering this agreement. If you use a Service for an organisation, you confirm that you are authorised to bind that organisation. You are responsible for accurate account information, safeguarding credentials and activity under your account. Notify support@nomad-node.com promptly of suspected unauthorised access.

3. Digital services and delivery

Services are delivered digitally through the applicable web application. Nomad Node Studio currently provides AI-assisted image transformation and short image-to-video generation. The public product page and checkout identify the access, deliverables, limits and billing arrangement for a purchase. Other features are not part of a paid offering unless they are expressly described before checkout.

4. Subscriptions

Nomad Node Studio does not currently sell recurring subscriptions. If a subscription is introduced, the checkout will state the billing period, included access, renewal price and cancellation method before purchase. Unless otherwise stated there, cancellation will stop future renewal and access will ordinarily continue until the end of the paid billing period. Price or plan changes will be communicated as required before they take effect.

5. Prepaid credits and usage

Some Services use prepaid credits. Credits are a limited contractual right to access eligible features; they are not money, stored value, cryptocurrency or transferable property. Credit consumption may vary by model, generation type, resolution, duration and computational requirements. The current usage range is disclosed on the pricing page and the deducted cost is recorded with the creation. Credit quantity, eligible features and any expiry are disclosed before purchase.

6. Payments, taxes and billing

Production checkout is not currently enabled. When payment is activated, prices, currency, billing frequency, credit entitlement and applicable taxes will be shown before payment. For orders placed through Paddle Checkout, our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for those orders and provides payment-related customer support and handles returns under its buyer terms and refund policy. You authorise the charge shown at checkout and must maintain a valid payment method for any recurring purchase. We do not ask you to send raw payment-card details to our support email. Billing questions may be sent to billing@nomad-node.com or, for a Paddle transaction, submitted through paddle.net.

7. Uploaded content and instructions

You retain your rights in content you upload or submit. You grant us and our service providers a limited permission to host, transmit, process and transform that content only as needed to provide, secure and improve the Services, comply with law and enforce these terms. You must have the rights and permissions required for your inputs and instructions.

8. AI-generated content

Subject to these terms, your compliance with the Acceptable Use Policy and payment of the applicable usage credits, Nomad Node Limited assigns to you its right, title and interest in the output generated for you by the Services, and you may use that output for personal or commercial purposes. This assignment does not extend to third-party rights in your inputs, to content owned by other users, or to the models, software and services used to produce the output.

AI output may be inaccurate, incomplete, unexpected or similar to output produced for others. You are responsible for reviewing output before use and for ensuring that your use complies with law and does not infringe third-party rights. We do not guarantee that output is unique, error-free or suitable for a particular purpose.

9. Acceptable use

You must comply with our Acceptable Use Policy. You may not use the Services for unlawful, fraudulent, abusive or harmful activity, interfere with security or usage limits, introduce malware, or use output to deceive or violate another person’s rights.

10. Our intellectual property

The Services, software, interfaces, website, branding and original materials supplied by Nomad Node Limited are owned by or licensed to us. Subject to these terms, we grant you a limited, non-exclusive, non-transferable and revocable right to use the purchased Service. No right is granted to copy, resell, reverse engineer or circumvent a Service except where applicable law does not permit that restriction.

11. Availability and changes

Generative AI and cloud services depend on computational capacity and third-party infrastructure. We work to provide reliable access but do not guarantee uninterrupted availability or a particular generation result. We may maintain, update or change features and limits. Where a material change affects a paid Service, we will provide notice or a remedy where required by the applicable purchase terms or law.

12. Suspension and termination

You may stop using the Services at any time and may cancel recurring billing as described above. We may restrict or terminate access for a material breach, non-payment, security risk, unlawful conduct or harm to the Services or others. Where appropriate, we will provide notice and an opportunity to remedy a breach.

13. Refunds and cancellation

Our Refund & Cancellation Policy explains subscription cancellation, unused prepaid credits, consumed credits and failed generations. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.

14. Disclaimers and liability

To the extent permitted by law, the Services are provided on an “as available” basis without implied guarantees beyond those that cannot be excluded. Nomad Node Limited is not liable for indirect, incidental, special or consequential loss, loss of profits, data or business opportunity arising from use of the Services. Nothing limits liability that cannot lawfully be limited, including liability for fraud or wilful misconduct.

15. Governing law and contact
